The State Construction Committee recommended the adoption at the first reading of amendments to limit arrests for women, Vedomosti correspondent reports.
At a meeting on October 9, committee members supported the adoption of a project aimed at humanizing criminal legislation in the field of legal proceedings. At the end of May, Vedomosti wrote that the amendments were prepared by the Supreme Court in accordance with the instructions of Russian President Vladimir Putin after a meeting with members of the Human Rights Council.
First of all, the amendments prepared by the Supreme Court introduce into the Criminal Procedure Code a distinction between violent and non-violent crimes, that is, not related to the use of violence or the threat of violence.
Further, it is proposed to allow a preventive measure in the form of detention only for crimes of moderate gravity of a violent nature, as well as for serious and especially serious crimes. Only in exceptional cases is it proposed to arrest in cases of crimes of medium gravity of a non-violent nature: when the accused does not have a place of residence or place of stay in Russia, when his identity has not been established, when a previously chosen preventive measure was violated, when the suspect fled from the preliminary investigation authorities or court
For women with young children, arrest for a crime of medium gravity will be possible only if the crime is violent.
In addition, the Supreme Court proposes to prohibit the arrests of people with serious illnesses included in the list of barriers to detention. Previously, the law only prohibited the extension of the preventive measure for such people, but not their election.
