The Court of Appeal upheld the recovery of TGK-2 shares as state income
The Yaroslavl Regional Court upheld the decision to seize more than 83% of the shares of TGK-2 to the state at the request of the Prosecutor General’s Office of Russia. About it it says in a message on the court’s website.
During today’s meeting, the arguments of the defendants’ appeals were considered. Having studied the case materials, the appellate court found no grounds for satisfying the appeals and upheld the decision of the Leninsky District Court of Yaroslavl, which on July 14 decided satisfy the claim of the Prosecutor General’s Office.
Lawyer Maxim Verzhak, representing the interests of Cores Invest (one of the legal entities whose share in TGK-2 was recovered), said that the shareholders intend to file a complaint with the cassation court, transmits Interfax.
The claim was registered on June 28. Kostroma Kogeneratsiya Limited, Janan Holdings Limited, Raltaka Enterprises Ltd, Litim Trading Limited, ex-senator from Chuvashia, businessman Leonid Lebedev and Debt Agency are also defendants.
The fact that the Prosecutor General’s Office of Russia filed a lawsuit in the Leninsky District Court of Yaroslavl regarding the conversion of shares of the energy company TGK-2 into state income, reported in July. It was noted that TGC-2 continues to carry out production and economic activities.
TGK-2 was spun off from RAO UES of Russia in the 2000s. and sold to private investors. The main owner then became Lebedev’s structures, but initially the businessman’s partner in the project was supposed to be the German energy company RWE, which refused to participate in the deal shortly before its finalization. Lebedev tried to sue the German energy concern in 2016, but was unsuccessful. In the 2020s There were suggestions in the media that TGK-2 would be resold to one of the major energy investors, but this did not happen.
At the same time, a number of energy companies bought from RAO UES by private investors later returned under the control of government agencies and state-owned companies.
