Lawyers explained the decision of the Supreme Court on the right of those mobilized to alternative service

Legal experts have drawn attention to the fact that the Russian Constitution and laws allow a citizen to join alternative service instead of military service only for reasons of his convictions or religion. The CTnews news agency writes about this.

Previously, such a right was recorded in a mobilized citizen from the Leningrad region, Pavel Mushumansky, noted lawyer Alexander Peredruk. The fact is that he was an evangelical Christian; in 2019 he was allowed to join the alternative service.

He ended up serving in the PNI from 2019-2021. Also, later Mushumansky was given a summons and then he again asked for an alternative – the Supreme Court approved the young man’s petition.

“A citizen of the Russian Federation, if his beliefs or religion are contrary to military service, as well as in other cases established by federal law, has the right to replace it with an alternative civil service,” explains Part 3 of Art. 59 of the Constitution of the Russian Federation.

Let us remind you that partial mobilization in Russia was announced on September 21, 2022. Within its framework, it was planned to call up about 300 thousand people for service. The completion of partial mobilization measures was announced by Russian Defense Minister Sergei Shoigu on October 28.
